Allgemeine Geschäftsbedingungen
§1 Weitergabeverbot
Sämtliche Informationen einschließlich der Objektnachweise des Maklers sind ausschließlich für den Kunden bestimmt. Diesem ist es ausdrücklich untersagt, die Objektnachweise und Objektinformationen ohne ausdrückliche Zustimmung des Maklers, die zuvor erteilt werden muss, an Dritte weiter zu geben.
Verstößt der Kunde gegen diese Verpflichtung und schließt der Dritte oder andere Person, an die der Dritte seinerseits die Informationen weitergegeben hat, den Hauptvertrag ab, so ist der Kunde verpflichtet, dem Makler die mit ihm vereinbarte Provision zuzüglich Mehrwertsteuer zu entrichten.
§2 Doppeltätigkeit
Der Makler darf sowohl für den Verkäufer als auch für den Käufer tätig werden.
§3 Eigentümerangaben
Der Makler weist darauf hin, dass die von ihm weitergegebenen Objektinformationen vom Verkäufer bzw. von einem vom Verkäufer beauftragten Dritten stammen und von ihm, dem Makler, auf ihre Richtigkeit nicht geprüft worden sind. Es ist Sache des Kunden, diese Angaben auf ihre Richtigkeit hin zu überprüfen. Der Makler, der diese Informationen nur weitergibt, übernimmt für die Richtigkeit keinerlei Haftung. Ein Zwischenverkauf und Irrtümer sind vorbehalten.
§4 Haftungsbegrenzung
Die Haftung des Maklers wird auf grob fahrlässiges oder vorsätzliches Verhalten begrenzt, soweit der Kunde durch das Verhalten des Maklers keinen Körperschaden erleidet oder sein Leben verliert.
§5 Verjährung
Die Verjährungsfrist für alle Schadenersatzansprüche des Kunden gegen den Makler beträgt 3 Jahre. Sie beginnt mit dem Zeitpunkt, in dem die die Schadenersatzverpflichtung auslösende Handlung begangen worden ist. Sollten die gesetzlichen Verjährungsregelungen im Einzelfall für den Makler zu einer kürzeren Verjährung führen, gelten diese.
§6 Gerichtsstand
Sind Makler und Kunde Vollkaufleute im Sinne des Handelsgesetzbuches, so ist als Erfüllungsort für alle aus dem Vertragsverhältnis herrührenden Verpflichtungen und Ansprüche und als Gerichtsstand der Firmensitz des Maklers vereinbart.
§7 Verbraucherschlichtungsstelle
Die Europäische Kommission stellt unter http://ec.europa.eu/consumers/odr eine Plattform zur online-Streitbeilegung zur Verfügung. Verbraucher können diese Plattform für die Beilegung ihrer Streitigkeiten nutzen. Unser Unternehmen ist jedoch weder bereit noch verpflichtet, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
